well he is in prison and we agreed on a divorce and I've heard he could file but he wil not do it. plus it could be cheaper for him to do it. also i need to know what to do . and if i can do it file it myself without a lawyer then how much should it cost me to do this. please help me.

Call your County Clerk of Court's office. They will be able to tell you the filing fee (depends on the state you are in) and where to get the forms you will need to do it yourself.

You can buy a "divorce kit" from an office or book store, but it will just have the same forms you can get from your county for free, and you'll still have to pay the filing fee on top of the kit's cost. Other than being details of "how to", a kit is a waste of money. The forms you can get from your county are pretty self-explanatory.

If you and your husband are not contesting anything, don't own property, and don't have children, then you can fill out the paperwork yourself, pay the fee, and then show up for the hearing (in which he may be able to attend via telephone).

My ex and I divorced peacefully and didn't contest anything. It cost us $172 filing fee and that is it. I downloaded and filled out the forms from the county. At the hearing (court appearance) I showed up and she was allowed to be present via telephone, since she was in another state. And that was it.

I'm sure there are programs that help women who want to divorce husbands in prison. Search the internet, or go to your local human service department.

If my husband went to prison, I'd divorce him to! Yes you can get an attorney & get it done! Good Luck! I don't think the judge would question the reasoning!

if there is no property and no kids you can easily do this without an attorney, just fill out the forms and have him sign them. He can get a power of attorney for someone to act in his place to go through the divorce.

you can go to office depot and get the forms,but if you don't know what you are doing i suggest getting a lawyer,dont wait for the prisoner to file,

if you want a divorce than get one. money shouldnt be a option. think about it.

if it is mutual, then you can do it online. try looking for it. it is really cheap
