Illegals are criminals. If 12 million people refused to file tax returns, should they get amnesty?

Just about EVERYONE breaks the speed limit, but I don't see the government looking the other way. Far from it - they're catching more and more of us by using more and more speed cameras.

At a first glance, when a considerable portion of the population of a country starts ignoring a certain law for an extended period of time, that can mean that the law is no longer socially adequate, and that a custom could have arised. It`s what we call "contra legem custom", or "custom against the law".

As a general law principle, a later source of law should prevail over the first. If this is our analysis, then there wouldn't even be a need for amnesty, because the law would no longer be in force (since it was derogated [erased] by a later custom, which is equally "law").

However, the specific subject you are talking about is quite more complex, for two reasons. First: in a population of 300 million, when 12 million break the law, this is not a significant violation. Second: taxes are of fundamental importance for the survival of any State/Country.

This means that to purport that this "law" could be derogated by a later custom would be nonsense. Neither would this "custom" have enough adherence, nor could it ever be recognized as law by the government or the major parcel of the society.

However, since you're probably talking about a minority (from what I understood, illegal immigrants), another quite interesting theory could apply: that of "resistance" or "civil desobedience". This involves sistematic failure to comply with a government's laws, in a peaceful manner. It worked with Gandhi, to achieve the independence of India. Millions of people there started disobeying the British government.

But the difference is that they were politically organized and had a clear common objective. I'm not sure that this scenario is similar to the one you described...

I think illegal citizen's for the most part are contributing members of society. I think these people are just trying to survive. That's not to say some aren't bad apples, but you get that wherever you go. I heard Bush's latest speech on the whole thing and well... it sounded like propaganda to me. And frankly, I thought america to be the land of the free and all that. If you take a look in the R&S section, you will know that there are a lot of people who are legal citizen's that take advantage of that or abuse it. Which is worse? Illegal contributing citizens or legal non-contributing citizens.

The IRS does not offer amnesty.

But for other crimes, yes, amnesty is offerred at the end of a president's term of office if he will not be re-elected. It cannot reflect on him if he isn't coming back for another term.

No. They should have to pay a higher income tax like 75% then American citizens. Maybe then they would go home.

Well you don't have to file tax returns if you made under a certain amount, its not that bad of a crime. as far as illegals, I dont think any have ever been chossen over me at work, so they really dont bother me any
