no before that would happen the usa could charge him for the 23 violations of the un resolutions that were a act of war voted on and passed by the united nations charter. the united states would enact this right to prosecute and the un would back it up! although in iraq saddam is in custody of the us government!

Definitely not either he will executed or even if not he will be too old the day US leaves Iraq. If US troops leave Iraq, I guess genocides will occur daily.
