i have a son who i was receiving child benefit for along with child tax creadits and working tax credits. his dad claimed for the child benefit and somehow managed ro get it. we have 50/50 care and for 20 weeks after i was still receiving ctc and wtc, turned out i was not entitled to this and have to pay them back £2500.
i am now pregnant again, only 6 weeks, but the question is, when i apply for wtc and ctc when the baby is born, can the inland revenue stop they payments till the overpayment is payed back or will they just reduce it?

If you share custod 50/50 it's only natural that you get 50% of the tax credits.

The inland revenue will hardly pay if you owe them but maybe you an set up some arrangement with them. Talk to an accountant for advice.

This will all depend on the current award you are in.

If you will have to re-apply for CTC when the child is born, then you will have to set up an arrangement to pay with them.
This is because they cannot recover overpaid amounts from different awards.

If the award had carried on (i.e you had another child who was eligable) they would have reduced your payments.

The best thing to do is call them and ask them:
0845 300 3900.
I would do it before 4 o' clock today as thats when they get busy.

if you was receiving child benefit for your ex to then get it you must have written a relinquishment letter stating you no longer wished to claim, if you didn't then get legal advise
your ex must have also claimed ctc & wtc for you to receive an over payment so if its found child benefit should never had stop for you the over payment is his not yours
i'd get child benefit who are now part of inland revenue to prove you relinquished your claim

as for your new claim when you have your baby, yes they can reduce your entitlement to get this money back

I was overpaid by ctc and was told that I'd have to repay it.This was last year and I only received 1 letter from them stating this.I still get ctc and they haven't deducted any from it or stopped the payments.

See a friendly Tax accountant or if you do not have one go to the Citizens Advice Bureau where they deal with this kind of problem on a daily basis for free, but go now - do not let it drag on.

check the situation with revenue and customs, i think they just deduct so much a week as otherwise they could be seen to be punishing children for the parents mistakes

they will reduce it, they have to pay you a minimum amount by law.
