I am currently working for an agency and have been for about 3 months. When I phoned yesterday to see how much holiday I have accrued I was told that the holiday year runs from October to October, so at the moment I have not accrued any holiday, and any holiday I did have has been wiped off. The woman was exceptionally rude and offered no help, so I have written an email to the MD of the branch asking him to reconsider.

When I joined the agency I did sign a contract, which undoubtedly states that holiday runs from October to October but I can't believe that they can simply wipe out these days? Any adivce as to what to do?!

This must be in America because we certainly would not allow this to happen in Australia. Holidays are sacred.

First of all, this sounds kind of goofy, unless it is a Federal agency - their fiscal year runs Oct to Sept. Also, I've never heard of accruing holidays, but possibly "annual leave" and/or "sick leave." Most companies run their leave on calendar year basis, so your company sounds kind of unique.

At any rate, you signed the contract, therefore, it appears that you are bound by it.

my advice to you is to read contracts before you sign and take this as a lesson learned. holiday pay is a BENEFIT offered by employers, not an entitlement for employees.

weigh your options. If you signed a contract, check if there's a grace period. If not, at least let them know that that clause should be pointed out rather than cause friction when there needn't be.
When all is above board no one can cheat...

If you like the job and pay, just be quiet and work hard. If you aren't happy, look for another job.

if it says that holidays do not carry over, then your screwed.
