you talk to him to and from work, and yet you still lie about knowing him. so you have a better way of calling that? it is considered cheating if you are spending more time with/talking to the guy aside from business or work related topics, and it is causing you to spend a lot less time with your family.

One of your jobs as a spouse is to make your significant other comfortable in the relationship so she does not have to worry about you straying. If you have friends of the opposite sex that is not your spouse, then be up front about it. It is possible that even if you are not having a sexual affair, you could be having an emotional affair. If you are more open with that person than your spouse, then you are on the phone with the wrong person.

If it is odd hours of the day and your spouse needs his/her sleep but you feel the need to chat, then call who ever is awake at that time of day. But don't hide the relationship

online chatting is cheating-if the chats are of the sexual nature---if they are doing the nasty verbally it's still sex---and YES your man is cheating----he's probably even meeting this person on the way home from work----or during work----he's probably even called in to work sick a few times just so that he can have a romp in the old hay with this online woman or man.

2,3,4,5 in the a.m.----the man is obcessed with the idea of whom he's chatting with....

I probably would put a block on all chat rooms----and IM ing----get the NET nanny and passcode block all those places----on your home computer----THIS won't stop his activity but at least you know he won't be doing it at home---

The time of day or night doesn't determine whether its cheating, it depends on what they are talking about. Get a key logger and install it when he is at work or something and go back and see for yourself later on in the week. They have a free one online called kidlogger you can download and its simple to use.

It can naturally arose suspicion because its an unholy hour unless the one calling is a family member or anyone veyr very close to the couple. You need to ask your partner about it. Let him/her know that you are aware of it and you are wondering. Have an open communication about it.

Legally I would have to say no, it's not considered cheating. Morally I definitely think it is cheating. She is devoting time to another man that she should be devoting to you and then lying about it. There's a line in the marriage vows that says, "Keeping myself only unto him." That means in all ways, not just sexually.

depends what they are talking about really, but it certainly would arouse suspicion and I would find out exactly what they are talking about. It is really suspicious that your spouse lied about knowing him, and that is the point that needs to be clarified, why lie if there is nothing going on?

I dont think that calling this other person is cheating(the actual phone call), but not telling the truth about it and calling so many times tells me that he or she is possibly cheating.

I don't know about cheating, but it's disrespectful and should definitely be investigated.
