I just changed my name with them and they made me take a new picture. I guess if I didn't want to they could have used the one on file, but I never asked them.

Yeah you do. I've lost my ID like 4 times in the past 6 months and every single time it is required to take a new pic

I don't think so because you can now renew your license online or through the mail...thereby eliminating a retaking of your photo.
