Unequivocally: Yes.
You can kill someone the first time you are drunk at the wheel.

Tell me how would you react if someone killed you daughter but it was "the first time".

Besides, just because it's the first time someone get's caught, doesn't mean they don't do it all the time.

You want freedom, be responsible with it.

Yes - at least until they sober up - that's the whole point is to try to keep the roads safer when you are traveling. The police are trying to keep people safe by arresting the drunk drivers - (usually - but there's always that one a**hole cop that gives the rest of them a bad name) Drunk driving does kill and it does paralyze and it does affect insurance rates for all of us - so yes they should be jailed

They are not being punished because they might hurt someone - but because they are recklessly endangering other people's life - same as shooting into a crowd - just because the bullet didn't actually hit anybody doesn't mean that shooter shouldn't go to jail - duh

Let's see, a drunk driver can indeed kill people I certainly won't deny that possibility. The second greatest killer on the highways is speed. Then among people killed on the roads there are folks who run stop signs and red lights. So...I propose we do arrest and criminalize the party goers AND first offense speeding, running stop signs and running red lights. Don't forget going the wrong way on a one way street or tailgating. If we jail one potential danger to others we should in fairness, and for the safety of all, put them all in jail. Don't you all agree?

I think it might be better to do some things to them.
1. No more license for 5 years.
2. Car is taken away from them and given to victim if there is any if not, it is sold by community to pay for drug and alcohol education.
3. They are forced to do community service wearing a bright orange jumpsuit that says DUI on it in big letters.
4. If they hurt anyone they have to make restitution including having wages garnished. If they don't have a job, they should be charged fines until they get one and if they don't they should be put in jail minimum 5 years with no time off for good behavior.

These measures would cut down on it big time.
My fiance was hit by someone who was high on pot and he is out quite a bit for car even after insurance payment, his arm still does not function properly from nerve damage in accident.

Jailed and revoked license for at least a year! It is like giving a child a loaded gun. A car is a 3000 pound weapon. Most likely the weapon will go off. Is this a chance you want to take? Killing someone? If you are under the influence you are risking the lives of yourself and others!

There isn't enough room in the system for them. Gee, you would be talking about thousands of people across the country every year. I am sure we would lose losts of good Judges (I am sure they get D.U.I.s, police officers and politicians, probably do too.)

I think driving drunk is wrong. However, jailing everyone who does it is impossible, considering that if you weigh 200 lbs. and have 2.5 drinks you are considered drunk in most states, that is crazy.

I don't support drunk driving, don't get me wrong here. I just can't justify throwing all first time D.U.I. offenders in jail.

Good Luck and Take Care

I don't think they should be jailed at all unless they have had an accident. They should get a large fine upon first offense and their license suspended, then second offense, they should have to go to AA and give up their license for a long time.

They should not have to go to jail because it is not illegal to drink and it is not illegal to drive. It is only illegal to do those same activities together. Also some perscription drugs say don't drive and people do anyway. But if they were to get pulled, they would not be in trouble at all.

No, because if we do we are on a slippery slope.
Keep in mind we punish drunk drivers not because they hurt anyone, but because they MIGHT have hurt somebody. Thus sentence is light.
If we start punishing people severely for behavior that MIGHT harm people then where do we stop?
Do we put a person who ran a red light in jail? Sped on a highway? Parked to close to fire hydrant? Forgot to turn on his head lights?

Yes, because one time is enough to result in disaster.
HOWEVER if one wishes to implement this, then there are things that should be done beforehand.
That includes teaching them in schools why its bad, as well as educate the public and let them KNOW what the consequences are.
Make the punishment equal for those who can be proven to have egged them on, and put signs up outside pubs and clubs warning about drink-driving.
Ethically, if you have educated the public and it is CLEAR that they know the consequences, then the law isnt wrong in exercising itself.

Yes I do. They shouldn't be drinking and driving in the first place. So if they are stupid enough to do this then they should go to jail. Good place for them.
