I am renting a home month-to-month and my landlord just placed a "for rent" sign in my yard. I was stunned, an they do that?

Yes since your lease is up when ever the date on the month to month says it is.

umm...yes and no...if you are having some kind of dispute with the landlord over habitability...and he don't want to fix it...he can but he'll have to fix the problem regardless.

If you are up to date on your rent...and you have not given notice...and there is no other kind of dispute between you...then he can't just rent it out and tell you to get out. The landlord must have a valid reason...such as you didn't pay the rent...you destroyed something...perhaps you have a pet and he/she says no pets.

I suggest you elaborate on anything you may be in dispute with your landlord about and I can help you more.

Unfortunately...landlord/tenant laws in most states lean toward the landlord...however...if you are being evicted...he must give at least 30 days notice...or whatever is the norm in you state. You can't be evicted just cause he/she don't like you...as long as you are paying the rent...and keeping the dwelling in good shape...no...the landlord must have just cause to evict you.

Please tell more as to why you think he/she has put the sign up.

One other note...are you having some kind of spat with a friend/or x? it is possible someone has given notice on your behalf and you are unaware of it....talk to the landlord and find out why he has done this...may be that he/she thinks you are moving. Check it out.

Yes, this is legal and they can also show a perspective tenant the home while you occupy it, as long as they give you appropriate notice--- usually between 24-72 hours depending on your state/city laws. They have to give you written notice to vacate, though, either 30 or 60 days from the first of the month, depending on what your lease says. It's very obnoxious, sure, but not at all illegal.

Did they properly terminate your tenancy by giving you at least one month's notice? And even if they did, you can still refuse to move and make the landlord file in court to get you out.

It would be really stupid of them to rent out a place that wasn't vacant.

Why don't you just try calling the landlord and asking him what's going on.

Yes they can but they ahve to give you notice that they want you out. I would suggest you turn the tables and find a place before he asks you to leave. he is trying to find another renter before asking you to vacate so the aprtment is not vacant for very long. Did you ask him about the sign......communication is the key.

If your lease was ending in 6 months they would have to keep it available to you until that date, but since your lease is month to month they are only required to hold it for you until the end of the month. Each party has the same commitment and in your case that committment is until the end of the month.

It is for rent when your month runs out, so yes.

they can do that it is their property. they have to give you proper notice (depends on the state).

in terms of showing the house to potential buyers while you are in legal possession, i do no think that is permisable.
