This is in NY where the age of consent is 17.

this is not me but two people who i know who have met 2 months ago and she claims they are just friends but he keeps asking her out. They have had sexual contact

The age of consent does matter, but so do the parents. If the parents do not mind, and really don't mind, then I don't see why not. It also depends on how mature she actually is. BUT, as long as you are sure she won't go and try to sue you later on (if you break up with her), then why not?

That's not a big age gap, but you're dealing with two problems:
1) Legality. if it's illegal to do anything physical, that can be a major strain and if you break the law, the GUY risks prosecution for statutory rape regardless of consent of the minor.
2) With one person in college and the other in high school, you're going to deal with more than the daily separation of different schools, you're dealing with the separation of CULTURES. The college student is going to meet more mature women at school. He's going to have access to all new information that he can't really share with his underage sweetie. He's also going to have a LOT more freedom which he doesn't share with a person who has to deal with her parents whenever she wants to go to a high school dance. College kids going to high school dances come off as pathetic and they know it. These things are going to drive a wedge between the two sooner or later, and it's usually the high school girl who gets left holding the emotional baggage.

Better to just wait until you're both operating on the same playing field. At least then you're not battling the law AND the logistics.

Absolutely not...especially since you probably started dating in high school. I mean if her parents aren't cool w/you dating i'd be very VERY careful but overall I think you're ok!

technically its illegal, but it really depends on the people. as long as no ones taking advatage of her, then theres really no problem with it. just think, in a few years it wont make any difference.
