If she's not supporting him (and it sounds like the state is doing the supporting right now), then no, you do not pay child support. However, you can't just stop paying. You have to go before a judge in family court and petition to have child support suspended until such time as your son is released from jail and back in his mother's care.

As a father myself, I would be thinking about my son instead of paying child support. I hope your son gets out of jail, and gets his life back together.
Most states, you still have to pay child support but you would have to ask a lawyer first.
Please help your son get back on his feet, and his life back together and I wish you and the child's mother, and the young man the best of luck in the world.
Good Luck

If you are required to pay by court order, then yes you do. But
then again everywhere is different. Check with your lawyer or
children's court house. You do have to pay for the time your son
is spending in Juvenile Detention. Also there is a fee, just for talking to a Probation Officer. You said he is in jail, he is too
young to be in jail, unless he has committed a felony.

I would talk to a lawyer. If you have a court order to pay support, then you must pay untill the order is changed,or the son has become of age.

sorry to hear about your son, you probably need to verify with a lawyer, but I am pretty sure there is a difference between emancipated and encarcirated? How ever he is your son? don't you care for him enough to try to get him some help?Is that all you are concerned about is wether you have to continue paying child support? how did he get in this situation any ways.??

Some states would say that he's not 18 or 19 yet, and you'd still have to continue to pay, but others, not.
Go to your local court house and find out! Not sence in paying her if she's not suppose to.

I would think you'd be better off talking to a lawyer and getting a legal answer than listening to a bunch of strangers on the interenet.
