I didn't know what category this question should go under, but i'm needing some information. . . . . . . . . . . . . I live in an apartment, and my apartment managers live right next door to me. . . There are a total of 12 apartments on this lot, and they all have bugs in them. Well, today, they came and sprayed for bugs to try to get of them (they do a lousy job at it). I was asleep, and my apartment wasn't clean, because i got off work this morning, and was to tired to do anything, so i went to bed. . . . I got off at 4am. Well, like i said, i was asleep and didn't know they come in here until my apartment manager tested my smoke alarm, and woke me up. Well, after he was done doin everything, he left a note on my door saying that i need to clean my apartment, because the bugs were crawling in other apartments. . . My question is: Is it illegal for them to be in here while i'm asleep or while i'm not here? If so, what can i do to keep them out of here while i'm asleep or not here?

Most landlords reserve the right to inspect and do repairs to property, and that includes the right to come in.

To keep them out when you are sleeping, I suggest putting a sign on the doorknob that says that you are sleeping, and also to get one of those pole locks that brace the doorknob against the floor, so that it can not be opened from the outside. At least those are the things that I would do.

Most rental owners & managers have the right to enter your apartment -you might want to check your lease for the rules that apply - like when they can come in and under what circumstances. However, they are expected to use common courtesy, and arrange a convenient time, or at least announce their arrival. You should probably speak with the manager and make your expectations clear.

BTW, leaving food out, and not cleaning will attract varmints. I suggest you take some time and clean up - you and your neighbors will probably appreciate it.

I don't think it is illegal You could just tell the person or ask them to knock and ask for permission before they come in. I would recommend moving to a different place if you are not happy. Bugs crawling around is petty disgusting. Since he is your apartment manager he does have a right I think but it may say in your contract that you have full rights. It is just common curtisy for someone not to come barging in without permission.

First thing you need to do is read your lease. I dont know where you live but where I live they give you 24hr. notice unless it is stated otherwise in the lease. They do have the right to enter in an emergency anytime they want, fire, water overflowing, things like that. You need to check the lease and talk with the landlord. Tell him he scared the crap out of you. And to call ahead of coming in so it doesn't happen again. Hope this helps, and good luck.

Your apt manager should have given you a 48 hour notice to enter your property. If they did that, then they have the right to go inside even if you are asleep. If they didn't give you notice, they cannot enter your apt. without your permission.

Your apt. manager should extend you the courtesy of giving notice whenever he comes into your apt. but if you tried to sue him or take some legel action against him you would lose.

Check your lease, you'd be surprised how many landlords put in the lease that they can come in as needed. If it's not in your lease it is indeed illegal.
