I am currently on a lease at an apartment I do not live in. My roommate screwed me over by ruining my clothes and other items, so I moved my stuff out. I paid her for one months rent, even though I was never there. And for the past month I have looked for a roommate for her. I have found one but she refuses to sign me off the lease. I have to sign a lease to live somewhere else! I am applying for an apartment with my fiance, but I need to know if they can see if I am on another lease. And if so, can I sign another lease? If not, what else can I do?

Both leasing companies will pull your credit report. The second one will be able to see when the first leasing company checked you out from the credit report history. They will want to know why someone else pulled your report a few months ago, and you're not living there, and will probably call the other company.

You can lease as many places as you want - imagine businessmen who have a place in several different cities. You are still responsible for you share of the rent at the old place, though. I suggest you speak with the landlord of the first place about it. Neither is obligated to let you out of your lease.

You could very likely be sued by the first apartment complex for breaking the lease.

Nope. But if the application asks if you are and you lie, you could be evicted from the second apartment b/c the lease agreement would have been based on your material misrepresentation.
