Answer A:
DVD Writers are capable of burning DVDs because they can operate on variable wavelengths.
CD Writers have limited capability of doing it.

Hence, one "cannot" burn a DVD in a CD Writer.

DVD (660m) and CD (785nm)

Yes, the technology is different.

Answer B:
Yes, you do need a burning software.
Although, windows xp supports burning of CDs and DVDs without installing any special software.
But then, windows' internal burning software can only burn data discs.
You can search for DVD/CD burning softwares on google.com or download.com

Whether the DVD you're wanting to burn is legal or not, you'll have to have a DVD burner to be able to burn a DVD. And although Windows XP has software built in to burn CD's and DVD's, pay $5 more and get a retail DVD burner, which will almost always come with Nero, the best disc burning software on the planet. It's definitely worth the money.

NEC, Benq, and Sony are the three best (for the money) DVD burners availalbe now, and are all available here: http://www.newegg.com/Product/ProductList.asp?Category=10&N=2010100005+1036506653&Submit=ENE&SubCategory=5 Lite-On isn't as good as the above three burners, but it's not horrible.

You can burn a 'VCD' on a cd burner though. VCD means Video Compact Disk. You still need software. The quality is poor. To burn a dvd with a dvd burner, if it's a dvd you want a copy of then first you'll need a 'ripper' such as DVD Shrink and then you'll need a 'copier' such as Nero, Roxio, Sonic). The thing you will need the most though is PATiENCE! LOTS OF IT! LOL! good luck... :-)
