Under what conditions does a parent not have the legal right to pick up their children from school? In specific, if a school has a bomb threat and the kids are moved out of the building to their specified shelter, do parents have a legal right to pick them up? If so, is there any documented law, legal case, or state policy for this other than that mentioned in the student handbook? I haven't found any substantial resources online.

The biggest problem I see is that it could interfere with the investigation. The best thing to do is let law enforcement do their job.

I would say that a parent always has the right to take their child from school -- after visiting the office and officially signing the child out. At our school, anyone who is listed on the child's emergency forms may take the child from school. Someone NOT on the list is not allowed to.

Oops, I just read your question more closely. Our emergency response coordinator has said that at the secondary location, the teachers will have the kids' forms. If a parent or someone on the form comes for the kid, the kid goes. There will be a long line to wait in for your child, I'm sure, since every kid's form will have to be checked.....

Well in our state it was argued when... so I decided to pull them out and home-school them. For me, it was better because I didn't want the call saying "we couldn't save your children when the man shot them"
this world has become so crazy that I don't feel like throwing my lambs out to the wolves...

You wont find anything on-line since they change this periodically. Go to the superintendent and have him give you a guideline.
