You sure can! And win too. Since alcoholism is considered a disease, you are covered under the Americans with Disabilities Act (ADA). Bingo! You got it pal. I make a tidy living doing just what you did. I have had 4 companies pay me tidy sums because they fired me for the same thing. But you have to "ratchet" it up a bit. Next time get in an accident. Then you can sue because they did not make reasonable accommodations for your drinking. A 2fer. Then sue for emotional trauma. Man you are IN!

Just becuase you didnt get into an accident, does not mean it couldnt have happened! There are risks just getting in a car,... why increase risks by drinking vodka while driving. If a cop would have seen you, he owuld have DEFINALTY given you a ticket . Imagine this: Your driving and you notice someone else in another car is drinking,... wouldnt u not follow too closly? You would try to avoid him, right? So the same way,..... the company does not want to ruin thier reputation over some one inresponsible. Be thankful to that company,... maybe from now on you wont do that no more and you learned a lesson. If you take it to court, the judge WILL give your former employer a nobel prize, especially if the judge has a family

The company is responsible for anything that happens connected with that delivery truck. When you drank vodka while driving it, you were violating the traffic laws. If the company had not fired you, it would be violating the traffic laws. If it allowed you to keep driving and you hit another car while drinking vodka later, the company would be responsible for the damages, as well as citations from the police. The company was attempting to avoid a lawsuit by firing you. It was not only legal for them to fire you, it was legally mandatory. You can sue anybody for anything whether the lawsuit has any merit. In this case, the lawsuit would have no legal merit. Good luck getting a simpathetic jury to hear your story.

You can be fired for drinking at work any time. Furthermore, in most cases during the first 90 days of employment you can be fired for any reason the employer feels like, they dont have to give any cause at all.
But I have a sneaking suspision that this question is a joke. Judging by the other quite entertaining questions sarcasmo has posted.

It is called Driving Under the Influence. If this in fact a real situation, you must not be too bright to be drinking on the job regardless of how long you have been with the company. it is people like you that make Auto Insurance rates increase for their sheer stupidity.

Assuming this is a serious question, the answer is yes -- you can get fired for such an offense. And please don't tie up the courts with another frivolous lawsuit. You know drinking and driving is illegal, you know it's unprofessional -- now go to the nearest AA meeting and start putting your life back together.

Yes, you can get fired because drinking and driving is illegal. But, if you can prove you're an alcoholic, then sometimes this is considered a 'disability' and you can't get fired. Bottom line, it was a bad idea.

No. Most companies have a 90 day probation period where they can fire you without notice. Dont know why they fired you though, drinking and driving on the first day of work... you idiot!

NO. Drinking and Driving is illegal in many states. Therefore you probably signed a contract that stated you would abide by all traffic laws while operatiing their machinery. Be thankful that all they did was fire you and not charge you with DUI or even something worse.

Besides the fact that it's illegal to drink and drive, it almost certainly prohibits drinking while working in the employee handbook, which you clearly did not read.
