Slander and Defamation of Character are perhaps the two most difficult torts to prosecute, and are often unwinnable.

You gave no details of why the state has done, or who did it.. i.e. a state employee? Nor did you give details on the context in which it was done, and the background.

Let's first give you some basic education on the ideas behind these torts:

Slander - Slander is the utterance of an untruth about another party with the utterer knowing or having willful disregard for the veracity of the statement. Most states also do not consider it a slanderous act if the statement causes no harm..i.e. telling your neighbor that the other neighbor wore a red dress when in fact she wore yellow is NOT slander, even if you didn't tell the truth. There are a number of defenses to slander, the most obvious one being the truth. If the defendant makes an allegation and can show by a preponderance of evidence that the allegation is true, and/or that the defendant had reasonable grounds to believe that it was true, then there is no slander.

Defamation of Character is related to slander. However, it is more based on the persistent publishing or dissemination of facts which would tend to put a person in ill-repute. Again, truth is a defense.

You indicated that somehow children were involved. If the state made an allegation of some sort, and the allegation was published, its very seldom considered to be defamation of character, even if the allegations aren't proven.

I recommend you consult an attorney licensed in your state. Be prepared to pay a significant retainer: these types of cases are difficult to win, and the damages awarded are typically very low.
