In this day and age all land belongs to some country. So you have to own the land, declare independence, then fight a war with the country you are trying to separate from. That is how many countries start. Even now there are regions in various countries that want independence. For example Spain has the Basques (I think that is how you spell it). Another way is the way England and the U.S. create countries after a big war. The Iraq-Kuwait thing in 1990 was because of one of these "creations" from the past.
Long story short, you go to war and then do whatever you want with the land, or it is handed to you by some big nation that fought the war.
