Appellate courts is a court of appeals which eliminates a as an answer.
Because it is court of appeals it usually makes judgements on constitutionality of a trial and the evidence presented as well as any new evidence that is brought forth. This being said a panel of judges must determine wether or not a trial was unconstitutional, this is different from any other court.
