She is on medicare and my dad is trying to fight against his brother a sister. We took her over to her house, Bobby ( My dads brother) has her keys... He was there at her house too and wouldnt let her go in her house. And said the nursing home was her home. What can my dad do? He is looking for answers... No one is really helping.

Your dad needs to get a lawyer, and have his mom make him her proxy, executor, and power of attorney. She needs to be declared competent. If the brother and sister are tying to keep her in a retirement facility and take over her house, then you have to get legal help on this. Good luck. Start today!

If I understand your story right I am assuming that it is your grandmothers house and your dad's brother won't let your grandmother in right? If that is true then your grandma has every right to call the police and have Bobby's butt out of there. Because one of two things will happen he will either leave quietly or go to jail. As long as your grandmothers name is on the document as being the registered owner of the house and her alone then Bobby hasn't got rights to jack squat. It will probably cause some tension i'm sure between your dad and your dads brother at family functions and all like Thanksgiving. But what it sounds like to me that will actually be a good thing if Bobby isn't there. Bobby sounds like a real jerk. Tell your dad not to beat him up or anything because he could be charged with assault.

If the house is still in her name no one can do anything. She can get back her house without a problem.See a Lawyer as soon as possible.I am really feeling sorry for your grandmother she must be so hurt.I will definitely pray for you guys.Don't worry at all but make sure you have the papers right. All the best.Do get back to us to let us know the outcome.SAI RAM

UNLESS THE POOR WOMEN HAS BEEN DEEMED MENTALLY INCOMPATANT, YOUR DAD SHOULD BE ABLE TO TAKE HER HOME WITH HIM!!!!!!! WHERE WAS YOUR DAD WHEN ALL OF THIS WAS GOING DOWN?? YOUR DAD NEEDS TO FIND OUT EXACTLY WHAT HAPPENED, AND WORK FROM THERE, AN ATTORNEY WOULD PROBABLY BE A GOOD IDEA TOO! SO SORRY FOR GRAM, BUT DAD NEEDS TO GET ON THE BALL IF HE'S GONNA HELP HER!!!!!!!!!

yup, I also agree if she is of sound mind and the doctors say she is, call the cops!!!!! Try the AARP, they may have names of resources that your dad can call and talk to. Senior citizens have rights, and sounds like your dads brother is a bum, trying to take over your grandma's stuff. Call the cops! (who has power of attorney over your grandmothers estate?) He can even call the court house in your county and talk to someone there.

Whomever she gave power of attorney to, is who gets to say where she lives and what happens to her stuff. I suggest you get a lawyer.
