My husband was approached by his supervisor and offered drugs. My husband refused. A few days later, he was approached again by his supervisor and a co-worker and told to take a toat so they would know he won't tell on them. After refusing again, my husband went to the owner to report them. Drug test were issued and they refused to take it. One person was suspended for 2 days. Since he went to the owner, he has been sent home four days out of five, the supervisor shorted him out of 10 hours of work on his check. The brother of one of the guys tried to spit on him. Who can he turn to for help? It is a small local privately owned construction company.

In a word, the EEOC. More to the point, under federal anti discrimination law, you are REQUIRED to file a complaint with the EEOC before you are granted a cause of action under the applicable statutes. In other words, if you fail to report to the EEOC, or obtain the EEOC's waiver for the same, you CANNOT bring a civil action based upon Title VII (Anti-disc. statute).

So, without more, CALL THE EEOC.

Unfortunately, unless it is a racial issue, little can be done.

Most people do not realize that they are not really protected by law when it comes to employment. Unless you can prove without a doubt that the problems occured because of your husbands race, then unfortunately he has been screwed by his employer.

I say this, not trying to make race the issue, but just stating facts as I know them. My husband reported his employer to OSHA for extremely dangerous working conditions. His employer was fined over $100,000 dollars and had to make at least that much in improvements and repairs. They later found out that it was my husband that reported them and they terminated his employment.

When we contacted OSHA to notify them of his termination due to his reporting the company, nothing was done. Even though he was told that he was being terminated because he had reported the company, they filled out the termination papers as lack of work which means that we had no recourse.

Don't be lead into believing that you have rights as an employee. You don't!

Wow, If the owner has not corrected the problem, I would talk to a lawyer. You should be able to consult one for no charge, and they will tell you if you have a case or not.

In the meantime, you can report them to the department of labor.

why are there so many people saying something about "equal opportunity" and such? This is not a discriminatory case! Who is being discriminated? Non drug users?

Why must people bring race or sex into everything? This is a matter of a superior abusing his powers to keep himself from getting in trouble.

You may have a civil case against the supervisor and the owner. Consult with an attorney.

Try the Equal Employment Opportunity Commission they investigate discrimmination. What a horrible experience--Good luck with it!

This is workplace discrimination in a way. I would seek a free consultation with an attorney who specializes in workplace issues. Wrongful termination, discrimination, etc..

Wow, I am impressed with Georgia's workplace rules...that wouldn't fly in the NE...the owner HAS to see that messing with your husbands check was to get back at him...do they use time clocks?

Start with the HR department at your work location. If they don't resspond then contact your local gov't office that deals with such complaints.

there has to be a employee board for all agencies that you are entitled to, one of them is the Equal Employment office call them and they should be able to put you in the right direction
