I'm being accused of being a child's mother and about to have my wages garnished for child support. I keep telling the Friend of the Court that I am not the parent of this child. I tried providing proof and they keep insisting that I am because the real parent (mom) and I have the same name. I been fighting this since February and I'm tired of it. What would you do?

In order for me to prove I'm not the parent I provided my SS# and my driver's liscene. They didn't have this information in the beggining now their trying to use this information against me to garnish me. I'm 23 yrs old I have no children, never been pregnant. The child is 12 yrs old.


I can do a DNA test but I don't want to spend money I don't have. Especially if I'll never get it back. Is there an easier way??

Did the court bother to have a DNA check done? If you are not the parent, and the DNA analysis is fairly done by competent scientists, the results should clear you.

I find it interesting that a woman could be misidentified as the mother of a child she did not bear. Usually, hospital records are clear on who the mother is for each baby who appears in their maternity wards. When a parent's identity is in question, most of the time it's the father.

And nearly always when a court makes an error like this one, the victim is a man who is being wrongly accused of fatherhood (which isn't a crime, it's just treated as one) because the mother can't remember just who the real father is, or the law can't locate the real father and so this other fellow will make a handy scapegoat.

Hire a lawyer fast. Then petition for DNA testing. Since you aren't the mother, that is the only irrefutable way to prove it.

That's different. Well, you will have to take it to court and show evidence to the court if the child support agency won't accept your evidence such as social security card, drivers license, birth certificate, etc.

follow the chain of command...if you talk to one person...nothing happens talk to a person higher up in the ladder. though im not too sure of who or what position the next person would be to talk to. sorry. and hire a lawyer
