There's no typical answer. It depends on how busy the person you choose to serve might be (it doesn't have to be the sherrif or even a for-hire process server, just an adult not connected to the case), and how hard the defendent is to find. Usually with divorces they aren't hard to find, but sometimes they are in another state. Sometimes you know where they are but they know the suit is coming and want to avoid it so they hide.

Anyway. It can be immediately if they go with you when you file, it may never happen at all if they move and leave no forwarding address.

court papers have to be signed for, the person if they know they are coming can refuse to accept them, and they are returned to lawyers, the lawyers then have to try a second time, if they are refused , then they go to family court and explain that the person has refused to accept them, after providing proof, court usually grants an order saying they are deemed to be served and set an order summing the person to appear before the court. once the filing is done in the court for divorce the papers are usually served with in seventy two hours.

Your attorney will tell you when they will be served. It can take a while. Also, your attorney will call and let you know right after the other person is served, but you have to ask them to let you know.

I am pretty sure it is up to the person filing. It gives them ample opportunity to think about it and possibly change their minds.
