I want to use a program that is free and doesn't have any malware to mask my IP address and not use a proxy server.

There is no problem with that. Go for it. (This does not mean that your ISP can't track you down).

Sounds like your planning on using the Tor program and the Torpark browser! Is it legal? Don't think you need to worry about it! Your not the one responsible for it's development or promotion and distribution, and, if not already it will shortly have such large usage that it'll be too late to try to regulate it. Any attempts there will for sure be directed towards the founders and not the users. Its development is backed by privacy minded individuals and groups that are willing to invest and fight for what they believe in, and also make a profit to boot! That's a lot of power behind the "movement". Sort of a privacy "Jihad", so to speak! Trying to regulate it at the user level couldn't be done as even proxy's, which the Tor thing really is, couldn't be made illegal at least at the users level because all the user's doing is surfing the web in a protected structured manor.
If theirs gonna be a legal battle, which is highly unlikely, it'll take place at the top. Even just getting "snooping" approved is not settled yet and won't be for quite awhile if ever!
In the mean time protect your computer, yourself, and have fun!

Yes it is legal to mask your IP. I use Anonymizer, and it is pretty good though.

Its as legal as masking your phone number while making outgoing calls.

I can't imagine that anybody has ever thought about passing a law against it.
