50/50 split down the middle. She cant make you leave the house, if she wants to move back you both stay there until the house is sold. Im assuming you both pay a mortgage on the place.

I'm truly sorry to hear that.
Presumably since you are married and unless you have made a contract, you both would have the same rights on the property and everything it contains.
The best is to go and see a solicitor to quickly seek legal advice.
I don't know about the whys and hows, but when people hurt inside, they become unrecognizable and do things which are so unlike them.
Be very careful who you seek advice from.
And remember that at the end of the day, it's your life; your choice, nobody else's; it's about what you want and is best for your peace of mind or the children if there are any.

Too many unknowns to give a realistic reply. Depends on things like.....are there children under 16 involved, what there ages are, and which parent they are with. If there are then her leaving maybe construed as 'desertion' and that would have an effect on the outcome. You are in a stronger position if you stay put, generally, but again it depends on the wider circumstances. She can't just turf you out but she maybe in a position to buy you ought, or vice verce. You need legal advice.

Even if she doesn't pay the house payment, it is 50/50. She left you, not the other way around. You have grounds for desertion if she left you. Find a divorce attorney and get advice as to what to do. There are no winners in this situation. You will have to pay 50% for the house if you stay BUT she will have to sell it to you.

In most states the party who stays, stays in the house..If she has been gone longer then 30 days,you have a very good chance of staying there.The thing is,in the divorce you may have to buy her half of the house from her or sell it and split the money after its paid off...Get a lawyer and discuss it with him...Note: Don't follow thru with this without a lawyer, you will get you clock cleaned...Good luck

It depends on if you have children or not cause if you do then she has more rights over house than you unless she is giving custody to you ,if you dont then its tough she left the house and I wud say she shud stay out ,change locks and tell her to get stuffed

who's house is it, are there kids, who pays the bills. If there are no kids. courts always favore the women. I wish they didn't.
