I want to replace the fence in my back garden on the left hand side as I look at my house from the front. Is this my responsibility or my neighbours?

If the fence in your garden is what is called a 'party' fence, then you'll own it jointly with your neighbour. More precisely, imagine a vertical line severing the fence in half, down the middle. You'll own the half which is on your side of the imaginary division and your neighbour will own the half on their side.

On the other hand, your fence may belong exclusively to you or exclusively to your neighbour. In this case, the whole fence will belong to whichever of the two of you owns it. The title deeds to your home will usually indicate who owns any garden fences.

There is no rule about whose responsibility the fence is depending on what side of the garden it is.

It is sometimes the case that if the fence posts are on your side then it's your responsibility.

Check your title deeds to see if there's any information in them. Land Registry may be able to help with this if your house is registered.

I would assume that if the fence is shared then the cost of replacement should be shared too. Have a chat to your neighbour. They may know about the fence ownership.

It would also be wise to get your neighbour's consent if you want to change the height or nature of the current fence. They may object.

I think your fences will be the ones on the left hand side as you look at the house, but check on the land ownership with the council. You can build a fence right next to your neighbours though if you don't like the one they've got, then at least it will look nice from your garden!

It depends upon whose land the fence is built and what clauses there are in the deeds. These things vary a lot. If you want to replace it then go ahead but ask the neighbour if they object first - they may even help to put money towards the costs.

I am responsible for the fence to the right of my back garden - but this is as stated in the deeds to the property - I believe it all depends on that ie there is no hard and fast rule

You will need to check the title deeds to find out who actually owns the fence. There are no rules (left and right).
It would probably be easier to just replace it yourself if you want a new fence - just check with the neighbours first though (younever know, they might go halves with you!!

One of the few advantages of sitting on the fence is that you are responsible for neither side
Check the deeds - a T mark will indicate to whom the fence belongs

Ask the neighbour if they want to go halves first, if not put it on your own side. It's always best to try to be a good neighbour the last thing you want is grief at home.

it was the right hand side that was my repsonsibility. Thought this was a given rule, but maybe it's decided at some point and then sticks for future owners.
