Since there is no legal divorce or separation, the status of the company remains the same. His title could be General Manager of the Universe, but that would not change the status of the company. If either one files for legal divorce or separation, then a whole different situation arises.

This is one of those things that should have been addressed in your business/operating plan. Look it up to see if it is. Otherwise you may have to buy him out/vote him out. If he is still taking an active role as President and this situation was not addressed when you started your company there's not really much you can do. I would try to discuss it with him calmly and try to figure out what his intentions regarding the compny are.

Him moving out has nothing to do with the company i assume you have a LLC or a S corp which means the company is its own entity and his status with you and your marriage has nothing to do with the company.

Probably none if he is still doing his job the way he should be. Why did he move out, do you need to start the divorce? If you get divorced then the judge will probably split things equally.

he is tech. still the part owner of the company and can still get money from the co. on less the co wishes to buy him out being you. with money from the business. than in writing you put he has no right to the company due to the payout.

is he still going to be working with the company? what is your position? If he stays with the company it should be ok but if he wants to sell get a lawyers advice to protect your rights to get you interest in the company.
