This has been going on since 4/06. YEAH! frustrating! ugh! I can not move, now it is not an option, that builds upon the frustration as you can imagine. I have called the cops, went to court, called the landlord, the cops are frustrated, this gal is in and out of the courts is the impressions I got when going to court. Her it is, she plays her music or TV or she does laundry, no big deal right? but she does this at 11pm, 3am, 1am, midnight, 5am, yeah! frustrated, she actually told one cop, she plays it loud at night because she doesn't want to disturb anyone, funny thing about that is, she plays the cops that she doesn't remember (I highly doubt she is sober) and so luckly more often than not, they are on to her, but more than come out get the complaint info and or tell her to quite it down, which takes them away from doing more important things, they are just as frustrated. Is there ANY legal repercussion that I can do against her, or the landlord? please anyone with REAL advise, HELP!!!

If you have a lease...Read the fine print. Somewhere in most leases there is a clause, that the tenants have a right to dwell in a comfortable environment. That isn't how it is going to be worded, I was just trying to word it somehow so you'll find what I am talking about...You have the right to live there with no problems that are not by your doing. If your the cause the landlord/management can terminate your lease, if the problems are caused by other tenants, you have rights, it is in the lease!!! somewhere...You need to get it on tape, get all copies of police reports, and get statements from other tenants if possible and have them legally recorded(notorized or whatever your county says is submissable in court), then take the landlord/owner of the building to court, to have her vacate the premises.

If you can get the cops to file a noise ordinance against her and have documented proof of their visits to the home then you can take legal action against your landlord if he does not evict her.

There are several legal aid offices in most cities that can advise you if you are not financially able to afford an attorney.

If you could also get other neighbors to side with you it could aid in your case.

File a case against your neighbor for public disturbance amounting to Unjust Vexation under the Penal Law.

Contact your local PIRG (Public Interest Research Group) office. They can get you in contact with an expert in landlord-tenant law that can help you resolve this issue.

Would earplugs help? I know that seems simplistic, but it may help. If the police cannot hear the noise on the street (over 50 feet away from her apt..) then she isn't violating any noise ordinance.

I had the same problem. I put the complaints to my apt manager in writing, as well as making phone calls about the disturbances.
I just complained enough and asked to be let out of my lease early. They complied and I moved, without credit problems. It was easier for them to let me move than take care of the problem, I believe, because I was just one person and the problem people were many.

Depending on where you live there is a tenancy act in most cities. You may wish to get a copy, I would also contact a lawyer to see what options you may have

Yes,take it in your on hands.Listen,she has to sleep some time,that's.when you need to keep her awake.Believe me there isn't anyone going to help you ,but yourself.If it were the cops neighbor,believe me it would have been taken care of,a long time ago.
