the mother gave me custody of her baby because she was already going threw a cps case with two other children so when she had her newborn on september 28 she wrote papers giving me temporary custody and about a week ago the cps worker said that they the mother had to get the baby back and turn the baby in before she has a kidnap warrant can they do that what can i do

Yes this is true.You should have went through legal channels.Get a lawyer to help you.Good luck.

Yes, my niece was in this situation and my brother took in her 2 wk old. A week later CPS said they needed the baby, they didn't want the baby in a relatives hand because she wasn't allowed to have any contact with the children and if the child is with a relative it is more than likely she will see the child. Once the child is in CPS they will look for a foster home for that child or you can petition the court to have the baby back, but for legal purposes the child has to go through the courts.

Ok first of all is she Native American?If so yes, she is protected under any state to have the child returned ot her at any given time. If you did go to ocurt and they granted you temp. custody of the baby then, you have a chance to take her to court for "breach of contract" which means that you two had a agreement which she gave ou temp.custody of hte child and you want a judge to determine the outcome.

If she wrote the custody papers and you went to family court and had them approved and filed with a judge, NO, if she gave you the child like you would buy a used car, yes they can.

what are the state laws where you live? check it out also does the father have any rights does he know about this?
