I was talking to my soon to be ex-spouse and He was asking me questions that pertained to our divorce and when I asked him why he said I was taping our conversation but I was not, then I ask if he was and he alluded the question and said he had to get off the phone now. can he use that in court???

I don't think it's permissable in a court of law since you weren't aware that he was taping it.

i think a judge will only hear it if you KNEW it was being recorded like if you called and left a answering machine message that can be heard in court e mail can sometimes be permitted in court. I'm not 100% just ask a lawyer most answer questions for free.

No, if you were not aware of it, it is not admissable in court.
