I am Native American, but what if an non-Indian comes onto the reservation and comitts a crime, can we hold them liable for it? Think carefully, I know the answer to this but do you?

ok, a non-Indian man goes onto a reservation and kills a Indian man. Can he be prosecuted under the courts of the reservation?

I am not 100% positive but I don't believe he can be prosecuted by the tribal court. However, federal courts have concurrent jurisdiction on tribal lands for specifically the reason set forth in your example, so no, he would not completely escape punishment.

Well in some areas Native americans belonging to and residing on reservations can in fact commit a crime and be held accountable in thier own court so to speak on the Reservation.. However.. I think that is limited and varies from state to state..

But I am Almost positive if you are not a trtibal member.. You're screwed!

Meaning you will not be protected that way...

No. a criminal cannot escape liability. Crimes on Indian reservations are prosecuted by Federal Government. If a crime is committed on Indian reservation it will be investigated by FBI and prosecuted in Federal court, and the offender will go to a federal jail.[1]
