LOL She can take 1/2 your retirement in place of hers. She can have 1/2 the equity in the house too. Twenty years is well over the limit to gain these things unless she remarries then she forfeits your retirement bennies.

Get her to sign a Quit Claim....then the house is yours no matter what.

1/2 of retirement?? Do you live in Georgia or NY...that's the only 2 states that I know that still have ALIMONY!

Unfortunately any property acquired during marriage is a 50/50 split...

I have been told that by a lawyer, but different states vary.
Most states yes. I have seen retired military lose half of their retirement, 1/2 401K, lost their house to their spouse and x-husband was required to make those payments.
It sounds tough, but I have heard of it.

Do not listen to the Reggie guy. The Quit Claim has no bearings on her rights to half the assets that were aquired during the marriage. A quit claim only releases her from having any claim on the property...and if she has a lawyer, he WILL NOT allow her to sign off on that until there has been an equitable settlement agreed upon and signed by both parties.

Depending on the situation. Is there any children? How old? What transpired between you two? Is the any prenuptial? You must take into consideration everything. In my experience the answer unfortunately is Yes. You should really discuss issues with a legal Representative.

401K split? YES! SORRY DUDE. She can also take that house right out from under you... If there is only one then you'll split it down the middle... UNLESS you cheated on her. If she cheated on you she could possibly not get the retirement money.

NO, NOT NECESSARILY HALF BUT SHE IS ENTITLED TO A PORTION OF YOUR RETIREMENT IN THE FORM OF ALIMONY. HOPE THE KIDS ARE GROWN OR YOU WILL PAY CHILD SUPPORT TOO. AS FOR THE HOUSE, IT MAY BE BETTER TO SELL AND SPLIT THE PROCEEDS AND START OVER OR JUST HAND IT TO HER BECAUSE I AM SURE SHE WILL FIGHT FOR IT BUT THE QUESTION IS CAN SHE AFFORD TO STAY THERE? IF SHE CANNOT THEN MAYBE YOU SHOULD KEEP IT BUT TRY TO TALK THINGS OUT CIVILY. GOOD LUCK.

with no pre-nup your soon to be ex-wife will take half of everything that was aquired during the marriage. so yes she probably will and there really isnt to much that you can do about it except for plea with her but that rarely works

Yes she can,, and if you are thinking of leaving her for another woman,,, she can even take everything,, that is if she know how..
