If u want the divorce then u should leave, why should he have to leave just because u want out, its his place of residency too.. just because ur the woman doesnt give u the right to stay and doesnt mean he should have to leave his home.. if u want out, then u find a place to live..

You move out. Do you have a family member or friend to stay with? He's not moving out because no matter how much of an a**hole men can be, they take divorce a lot harder than we as women do. Before you move, consult the advice of an attorney and make sure you don't need to file separation papers before you leave. (If he's abusing you, leave asap!) The reason you may need an attorney is so that you don't have him filing grounds of divorce based on desertion. Most lawyers will answer basic legal questions over the phone or for a nominal consultation fee. There are also some free legal advice on the internet or check the blue pages in the phone book for a legal government agency. Set yourself free. Life is too short. You can do this.

Most people just say "move out", but if you actually leave the house, that might cause problems for you in the divorce preceedings because you no longer show a "need" for living in the house. A friend of mine had this very thing happen. So...I would simply move into another room of the house, serve him with divorce papers and try to move on, ignoring him as much as possible. Make sure he knows that you aren't leaving, and if he becomes at all violent or arguementative, call the police.

It sounds like your husband is not giving up on the marriage. If you want a divorce really bad and he won't move out, then tell him if he does not move out then you will.(Not that you really will, this is just to push him) Or you will go to the police barracks to have him physically removed from the premises if he still won't.

Well it depends, are there children involved?
If not who paid for the house?
Did both of you or was it paid for by him alone?
Actually when you are married everything belongs to both of you....
The only reason you should try to keep the house is if there are children from this relationship and you have to take care of them....
No children, and you want the divorce then you move out unless this was your house before he came into the picture!
But then you didn't give us enough info to help you much!

You got kids? I would go file for divorce, serve him, and move out but if you got kids, serve him, you stay there...sleep on the couch, mind your business and wait for the court date. Once your mind is set, it's set. Thats really all you can do at this point. If his name is on that lease or whatever, you can't make him leave, but a judge could figure all that out for you and he would't have a choice. Hope it works out, girl...Stay strong....

You haven't given much detail. How do you expect to get any quality advice from morons online, particularly when you give such vague information?

Is he wanting to work things out, but you're unsure? Is he trying to get you to leave and be out on the street? Is he afraid that if he leaves you won't let him back?

You do know how to get out of your house, right?

Move out, or you will look like you married him for his $. Then get a lawyer and get the house back. Your car back, his car back, his stereo back, his entire potfolio. Then feel bad about yourself cause it sounds like you did marry him for his $.
