The seat cover should probably be in the up position when in use. I have found that when the cover is left up all the time, dust in the air will settle on the water and create a ring around the bowl. Also, the lid down prevents any dropped items from getting into the bowl. As to which is more sanitary, that all depends upon your own personal housekeeping abilities.

Toilet seat covers are only found in residential applications. The reason commercial toilets do not have covers is with multiple users and the cover down creates a warmer more humid environment, even with A/C. Lower light, poor air circulation and the introduction bacteria from multiple donors, the bacteria will multiply much faster. As far as male aim goes commercial seats are shaped like a horseshoe, open at he front to help with the dribble issue. In short the cover is for aesthetics only. Aesthetics is a branch of philosophy that deals with such notions as what is ugly, beautiful, funny or artistic. Therefore as with most things in life, it is what you like. Test your toilet, when you leave for vacation close the lid. There will be much more growth around the waterline and above than with the cover left open. Note: Just my opinion but, Myth Busters is TV entertainment in a controlled environment. Also opinions are like peoples back sides, everyone has one and most of them STINK!

Technically, having it kept down is the more sanitary option, because it traps the bacteria in the toilet, but it shouldn't matter too much if you make an effort to keep the toilet clean. My boyfriend and I have two separate bathrooms, and if he wants to keep his toilet seat up, I'm not going to stress about it, but I will usually clean the toilets about twice or three times a week.

I think down is more sanitary. It keeps the dog from drinking out of it, lessens the chance of you accidently dropping something valuable in it and you can use it as a seat. And of course it will be more sanitary if you clean it regularly.

The cover should be down when you flush. It aerosolizes some of the contents and you end up with fecal coliform bacteria on everything. EVERYTHING. Like your toothbrush. And the walls. The toilet paper (yeah, really want to wipe with that). The towels, the sink, the faucet and knobs. The doorknob.
There's a MythBusters episode on this that was quite entertaining.

Certainly down. When the toilet is flushed, the water and air act in a similar manner as an aerosol can... so nasties are literally sprayed around the cubicle. The seat down contains the nasties.
