Is she still paying the rent? If so, i would just let her stay until the lease runs out and sign up a new agreement with her. If she has failed to pay rent, then the agreement has been broken and she basically has no legal standing as her name isn't on the lease, she is basically 'squatting'. You could go and see the local sheriff and have her forcibly removed from the premises.

Serve her with a 30-day pay or quit notice now that you have served the 3-day notice. If you live in California the law states to serve a 3-day notice followed by a 30-day notice. You can go to your local court house or city hall for more advice. They are a great help. Make sure you deliver in person a copy and mail to her a copy as well. By the way take her to court if all else fails...

I don't think you can do anything, assuming she has already paid the rent for the next month. The rent was paid in her separated husband's name, so you can't do anything that I know of. You must realize the lease protects you, but it also protects the TENANTS from unlawful evictions, such as a landlord wanting someone out of their place, pretty much irregardless of their reason. Of course, that would not apply if she was trying to burn the house down, but you get the idea, I hope. You signed it; you got to live with it.

You need to issue a 30 day notice. Why isn't her name on the lease, if you rented to a husband and wife both names are normally included in the lease, not just one. But either way it is customary to give a 30 day notice.

If she is paying the rent who cares that's what it's all about anyway????? When the rent money stop then yo have a problem. Then you do an eviction on her and get a judgment on him and her for the rent that is owed and you can keep the deposit. This way you have them both in the bag. They might not worry about it now but later down the road they will worry about it.

i own 51 rental properties take my word for this;she's not on the lease she is trespassing,she is a vagrant.take the police with you and have her arrested.tell them she has forced entry into the apartment and you have no idea in hell who she is.

Well maybe you should let her stay until she can find an appartment.put the app up for rent in the mean time but you wont be able to rent it until the 1st anyway.just let her stay.
