just thought id add that we dont actually get along with the old dear next door and are wanting the vine to stop her looking through our fence. we would really prefere not to speak to her and are just wondering if she can get us into trouble for planting one as it going to grow through her side as well.

I don't live down under, but if you own the fence, AND the vine,
I would say that it is entirely up to you.
If you did not install the fence, then you would be prudent to talk to the neighbor.
If neither of you installed the fence, it belongs to the house that installed and owned it originally.

You can plant the vine on the fence without asking. But he can cut off any part of the vine that comes onto his side of the fence without asking.
So, you might be smarter to ask.

Gosh I really don't know. I would go ahead and ask them to be on the safe side. But who wouldn't want to have that glorious beautiful flower where they could admire it. But that is just my opinion. If I were your neighbor I would say yes/
