Im 19yrs. old a on 10.13.06 while on the freeway,I was cut off by another vehicle. I slammed on the brakes so the man would not hit me, my car skidded and hit the wall of the free way head on. My car bounced off made a complete circle and the rear of my car hit the wall again. My car was totaled. According to the manuel they should have gone off if my airbag indicator light came on everytime I turn on my car, it does.The car is a 2002 Nissan Sentra GXE. The car was purchased as a new/used car from Carmax, who is famous for their 200 point inspection. Its the reason I decided to buy my first car from them. My mother and I are consedering sueing, my question is should I? If so for how much and would I even win?

Alot of times airbags are removed from used cars and sold in after market or black markets. Have the air bags inspected. If they are not there or have been replaced by something other than the original manufacture's equipment you have good grounds to sue the people you bought the car fromm. Also contact Nissan ASAP, they will send an investigator. Don't dilly dally, be proactive, be GUNG HO!!!!!!!!!!!

Also, you may want to file a complaint with the Better Business Bureau and follow up on it.
Don't let them sweep it under the rug at your expense!
You can protect the next customer from going through this (or worse).
They will most likely offer you a small amount of money in exchange for you to sign a waver saying that you will not sue for more money in the future..... don't sign it.
Talk them up to at least 3 times whatever they initially offer you if you want to take the money. They will pay it.
I'm glad you are still alive to tell your story!

If you were INJURED as a result of the airbag not deploying, then you may have a case. If not, you have nothing to sue for. You don't win a lawsuit for something not working properly unless you suffered some loss.
Best bet is to see an attorney that works on a contingincy basis. It costs you nothing for a consultation. If they accept your case, then it may cost you little or nothing unless you win the case.
But, be sure you read EVERYTHING they give you to sign. They may TELL you that there will be no cost to you but the reality may be very different. For example, they may not charge you any attorney's fees, but telll you that you have to pay filing fees. These are legitimate expenses, but unless you are willing to incur these costs, then you'd just be wasting time.

I gotta ask, what happened to the guy that cut you off? Did they at least find him and cite him? I am curious because I have nearly had that happen to from crazydrivers.
But on the lawsuit, it is best to consult a lawyer before proceeding, maybe see if Carmax offers you a settlement or something.

if you do your research, and find a good lawyer, you have every right to sue and win. when you slammed on the brakes, did they lock, and if they did, was your car equipped with anti-lock brakes? if so, you have even more to build up your case. but make sure you get your details right, because they will drill you. good luck
