Neither. You need three convictions for 3 strikes laws, which are only in a few states. It doesn't matter how many times you are charged.

You are referring to the "Three Strikes" law which would be determined on the State level. California is presently the only state to be following that guideline.

To be a little bit more clear...Three VIOLENT..felonies, crimes where a weapon was introduced, and a violent crime occurred...California is the #1 state but it is being enacted in several others..and yes their are many cases were it is being appealed

It is called the repeat offender clause, and usually ads thirty years to whateve sentence is handed out for the third offense. In some cases, it may be life. BYE-BYE!
