The Constitution. The American theory is libertarian--arising out of the Age of Englightenment. All rights belong to individual people. In America certain of these rights were given up to the states (formerly colonies). In the written U.S. Constituion the people gave up certain rights to the federal govenment--and this is its authority. All the remaining rights belong to the individual states or remain with the people.

I'm assuming you're referring to the different powers given to government by the constitution. Expressed powers, Inherent powers, and Implied powers.

Expressed powers are powers that are clearly written in the constitution.

Governments only have the authority you personally give them/
since i was not given a choice to live here and follow their law
i don't have to follow it and they can deport me I will leave happily.
