Yes, if the parents insist on it or if she's young enough. The idea behind the consent laws is that children and teenagers are not informed enough or adult enough to make their own decisions. This makes sense, to a degree. Even kids as old as sixteen are notoriously stupid about some things and also easy to push into doing things. Teenagers are still impressionable and don't always understand the consequences of their actions. Of course, there is some leeway for them. It's not often that an 18 year old will get prosecuted for sleeping with his 16 year old girlfriend, for instance, though it does happen.

Yes, the law requires that both parties be LEGALLY old enough to consent. If the girl was under the age of consent, then consent wasn't legal and the man can be charged.

Yes they can be charged. Even if nobody is pushing it, the state will push it once a case of this sort is brought to their attention. A girl that is under the age of consent cannot make an educated decision especially if she has some older sick perv trying to pressure her into it.

ABSOLUTELY!!! By definition, the girl under the age of consent (usually 18 years old) is not old enough, or mature enough, to give "informed consent". The assumption is that she does not have enough life experience to understand the consequences of consenting to sexual relations.

It may seem dumb to set a specific age, because obviously girls (and boys) mature at different ages, but the law had to set a boundary somewhere.
