What would happen to the totally innocent con-joined twin if the guilty one, found guilty in a court of law was sentenced to a mandatory prison sentence?

What options could the Court arrive at given such a hyperthetical situation?

But WHAT if the innocent twin could NOT see what was happening at that precise moment - it being a spontaneous act as opposed to pre-meditated?

Suppose the guilty twin knew there was a weapon within reach, but out of sight to the innocent twin? (depends on where the con-joined twins are actually joined)

good question,

given the serious nature of the crime it would hypothetically be then custody would normally be the sentence, however in this country it would be completely implractible. It would be in the public interest to prosecute the casepresumably, however it would not be in the public interest to put in place a punishment that would unfairly punish the innocent twin. Therefore I would guess that the punishment would be more enlightened than the one proposed.

So if said solution could not be found then the court would have to move to not punish or even dismiss the case asit would not be in the interests of justice to punish an innocent person regardless of the heinous act that had preceded it.

This is a facile question.

If one co-joined twin murdered someone, surely the other co-joined twin is, at least partially responsible, for doing nothing to prevent the murder !

How could one twin kill someone without, at least, the tacit agreement of the other ?

All the innocent twin would have to do is move away and the 'guilty' twin would, logically, be physically removed from the situation.

Have you really nothing better to do ?

This has acctually happened before.

Upon review of the case, the judge had no choice but to release them both as it was wrong to imprison an innocent man

The twin would be in nearly as much trouble for witnessing the crime that had taken place and not acting to stop it. Aiding and abetting.

also if the innocent twin saw the crime being comitted how would they go to tell the police?

well, why didnt the innocent one try to stop it? i mean, dont they have use of half the body? if it were me, i would have just sat down and lot let my attached sister do anything that i didnt want to do. and if she DID try to do something, i would have called the cops and said i was being forced to do something against my will and have her half hauled off to jail. see how she likes that.

OR....
what if the guility one murdered the innocent one?!?! oh wow, then what?! go to jail with a dead body attached!?

I think that any reasonable jury in this country would come out with a split decision
