I was told since we are married it's both our place.I rent and the lease is in my name only!!! I've asked him to leave and he wont.If I move (the lease is not up yet) will i be on the hook or will he?

talk to your landlord they may be willing to break the lease for your safety. you can also serve him with eviction notice, giving him 30 days.

Depending on where you live, whoever signed the lease is responsible for the property. If your husband does not leave, you can evict him (I had to evict my three sons). The police will only assist if he has inflicted harm upon you. In California, it is a tiring process, because you have to give that person 60 days and then an additional 10 days; after which the police will then escort the person out. But you do have to serve him the proper forms (see a sample on the link below).

Married or not, if you signed the lease, the landlord will seek YOU as the responsible party. Also, check your lease and see if there is a restriction in having someone live there without being on the lease (the landlord could interject that you are not abiding by the lease and ask you to move).

You would be responsible for the lease. Call the police. Break the lease if you have to but make sure you already have a place to stay or work out arrangement. Ask the police if they can give you a number to the local women's battered shelter in your area. In some cases, they can help with relocation.

If the lease is in your name only then you will be held responsible if you leave. All you have to do is call the cops and tell them you want him out. His name is not on the lease and he is abusive so you want him to leave. The cops will make him leave. If you get him out, make sure you get the locks changed. Be safe...

I know where I live you can break a lease legally by stating in a certified letter to the mgmt company or landlord that you are not feeling safe and secure in your current living arrangement. That way neither of you is on the hook so to speak. also get away from him and get yourself a place and do not let him know where it is. get restraining order also. Good Luck and god bless.

File a complaint with the police and request a restraing order and mention that you live together, he will have to move out, since the lease is in your name.

Go to the court house and get an eviction notice served on him. I believe you go to the magistrate court house. In the mean time document everytime he threatens and beat you to the police in order to get a restraining order. Do this now before it is fatal.

You would be responsible for the least... have a talk with your landlord ask them if they can transfer the least in his name for the time remaining... if he is willing to take it over, there should be no problem... then u can leave with no headachs... if they wont transfer the least, wel call the cops and get him outta there

you need money and a lawyer..... get a restraining order and have it served to him while he is at work.......the most important thing to have is a plan........when my ex and i broke up i wasnt working - but i planned it out - we bought the house in both our names. but i talked him into moving out for a week so we could stop fighting.......the same hour i had my dad come over and changed the locks and i filed for divorce and had him served and he was no threat to me - but its protection - just in case.....
