What the hell? All of you people talking about sueing and not paying are the reason so many small businesses cant afford to stay open, both to pay you and to pay for their insurance. A car is a very complex thing and there are many things that work together to cause a problem. Fixing one will solve the problem temporarily, but unless they are all found, it will return. Is it really fair to refuse to pay for all the time spent to try and fix the problem that has already been made? Would you want to do all that work for free? Think about the situation before you open your mouth, or type. You people are whats wrong with America. Learn some ethics.

Not really, sometimes these things are a process of elimination .. He should have stuck with it till he was sure it was fixed in the first place ..if you take him to court he will hate you forever...but you did pay for a repair that didnt get fixed.. you need to talk this over with him.. and tell him how you feel... then if he wont help you .. you have no choice... I would not tell him that your considering taking him to see Judge JUDY >>> LMAO!!! He may be trying his best to help you.. I took my Cadillac to the Cadillac garage in New Philadelphia, Ohio and they charged me $190.00 and marked on the bill that they called tech,support But the problem still isnt fixed.. and Im not too happy... I thought they should have fixed the problem "Their the Cadillac Dealer" or not charged me.. I run a garage and my policy is if I cant fix it I dont charge for it... I guess it pays to pic a reputable Service Center..where they have Trained mechanics that are capable of doing the repair...I hope this helps you... Good luck

That may depend on the problem for instance if it is Electrical, Electrical may be charged time and material because you have to find the problem. Unfortunately even if he didn't find the problem he still spent time looking for it Sorry for the bad news but it is what it is.
As far as not giving you car back with out payment he can do that also it is called a mechanic's lean.
If you feel as if you have been dealt with unfairly you will have to pay him to get your car back and then take him to small claims Cort to get your money back.

Don't take your car back to him, and if you already have negotiate a settlement and get your car back. Then take him to small claims court with all the documented evidence and sue to get your money back. If you can afford it, take it to a dealership and have it properly diagnosed. If it was some thing you have already paid for you have a good case. I always caution my friends that there are disreputable shops that start at the point furthest from the problem and work towards the solution.

By law he can get you for diagnostic fees and the applicable hourly rate associated with them at his shop. Most shops use Chitlon Book time. If he has replaced parts, you'll owe him for the parts and the time to put them on. If you don't pay him, he can slap a mechanics lein on your car and he'll own it. If he can't fix it then I doubt it he'll want it.

I agree with the small claims court idea, plus report him to the Better Business Bureau, which keeps track of shady businessmen.
