No, from what I understand. What ever you attain before your marriage you keep. What you attain during your marriage is community property ( unless you have a prenup), sound like you didn't. Which means I would wait to buy the house after all the papers are singed and that waiting period they give you as a , "just in case you two want to get back together"... period if over then I would buy the house. Then it is not at risk.

Hire a female attorney that can investigate these issues and win the kids for you. In most cases women get custody of kids but not always so you do have a good chance. You have to demonstrate your ability to take care of them and provide day care for them at any time. Get your ducks in a row and provide proof of her negelance for the court. When the kids turn 12 they can make a decision to live with the parent of choice. You need to do the right thing for the kids and not allow her to be an irresponsible mother. Cutting themselves and burning themselves needs to be brought forth as well as leaving the kids for long periods of time while out partying. Stay strong and know that you can prevent this with the right legal aide. Get proof! Provide it to a lawyer and she will not be able to move the kids away. Good luck.

Yes, because you are still legally married. She would have to execute a Quitclaim Deed, Grant Deed or Warranty Deed (depending on the state where the property is) to relinquish her claim to any future property interests. You'll probably need to hold off on buying a home until the divorce is final.

Check with your attorney.

Possibly. Do you have a legal separation agreement in place? If you do, then you should be fine. But if not...... joint marital property!

Consult your lawyer.
