It is a misdomeaner offense and It did not happen at work nor have I ever done it at work or came to work that way. My job performance is never an issue. I'm a fast food assistant mananger. I only have been smoking for two weeks to help me sleep cause al the "legal" sleep aids make me itchy I'm 39 years old

I called him to get money for bail,he's been my friend for twenty years.I live over 50miles from work so I couldn't get My money over there that fast.Like I said I have only done it for two weeks and I was with someone else when we got pulled over. I wasn't smoking in the car but he was,I only do it before bed a quarter oz. will last me 6 weeks so this isn't the only time but haven't done anything for 18 months. so if you take a sleep aid that makes you a pill popper? or if you drink before bed that makes you a alcoholic? some small minded people out there....

smoking pot isn't any worse than drinking alcohol, and not one of you can give me ONE REASON why it is, aside from the fact that pot is illegal. and guess what? once upon a time in the 1930's, alcohol was illegal! you believe something is bad just because your government says it is? pathetic sheep.

It partly depends on what your company's employee policy is. Some company's have a policy that if there is any drug abuse, whether on or off the job, it is grounds for termination. I think the problem that your boss has is that he/she is worried about you coming to work high, worried about what kind of impression you will make on the younger employees. Also, it's a character issue. As an assistant manager you are supposed to be setting the example for the other employees. Depending on what state you're in, your boss might legally be able to fire you with no reason at all. The state I'm in is a "right to work" state, which basically means any employer can fire any employee for any reason they want, or for no reason at all. It sucks, but it's legal.

How did your boss find out if it didn't happen at work? I think he can still fire you if he thinks you are not fit to work in the restaurant because you use drugs. Its like if you saw one of the other employees mugging an old lady. It didn't happen at work, but it says something about their character. Also, he probably doesn't want to take the chance that you will come to work high one day. But maybe you should talk about it with your boss and tell him that you will stop.

If you are a fast food assistant manager you are probably an at will employee

That means you can be fired for just about anything. And pot smoking is not a protected class.

You are 39 years old, not a 16 years old person who thinks that he can do anything he wants... You know the policy, you know what is legal or not, you know what is correct... You know pot is not allow and you did it, so you need to face the consequences, good luck looking for another job... and be an example e for the next generation...

What is your employer's written policy? Most employers have something to say about it. If you need to sleep won't a glass or two of alcohol have the same effect legally?

Edit: Suggesting alcohol instead of pot isn't being small-minded. it just happens to be legal in moderate amounts and provided you aren't driving afterwards. Whether that is right or wrong is immaterial.

I have never understood why pot is such an issue people need to look at alcohol abuse and its legal to by booze.....dui ,death,health problems,anger,rage and lots of family problems.Now lets see what are the dangers of pot oh yeah potsmokers get really mad if Taco Bell is closed at 3am,smokers are hardly ever accused of fighting or making trouble as a matter of fact I think it should be legal and some of these uptight folks should partake.I believe I would have to fight that one ask your boss if any of his employees have been arrested for DUI or domestic abuse PLEASE

Unfortunately there is nothing you can do. In America your boss can fire you "for any reason or for no reason at all". Misdemeanor conviction is a good enough reason.
The only time you can sue your boss for firing you is if he fired you because of you race, sex, age, or religion.

You are showing disregard for law or rules. In an employer's mind, what makes him think that if you disregard that rule, that you won't disregard the company's rules just because you feel like it?

He could just make you take a drug test and then fire you..

What is this...feel sorry for the pot head day?
