The theoretical maximum at jury trial is 7 years in prison. However, more typically for sums up to £20k you would expect a maximum of 9 to 12 month sentence, if prison was even deemed appropriate.

For a summary (magistrate's) conviction, the maximum according to the guidelines is 6 months, plus a fine of up to £5000.

'Fess up and they MIGHT treat it as a "summary offence" (a lower grade) and the worst then would be 3 months. But £17,000 is a lot to be an oversight, and if you have any previous form on this they may well want to nail you.

As a taxpayer, I do sympathise with the authorities - and the really annoying thing is that (if you're guilty) we'll now have to pay even more than you stole just to keep you in prison for half a year!

Expect a custodial sentence of a couple of months, possibly longer. I doubt with that much owed you'll get community service. You'll still have to pay though.

If you are guilty I hope you get the max. That money could have been used by those who really needed it.

But, if you offer to repay and start making the repayments, then you may find it helps reduce your sentence.

I know of one person who had 30k away and got 6 months

whatever it is it can't be long enough. I hope they give you a sentance and stop you getting a single penny ever again
