I have been having a problem with One-Tel who have, through a debt collecting agency been pursuing me for payment of an account which I have already paid(will not bother you with the silly correspondence)and I am getting pretty p***** off and considering going after them for slander(or is it libel?)

Onetel is now owned [for our sins] by . . . . yes you've guessed it - TalkTalk - which is owned by . . . The Carphone Warehouse! Go to www.click2complain.com and you will find the procedure to follow through the ombudsman dealing with the Telecoms industry.

Then join the club - with thousands of others being treated like trash by the smooth talking Charles Dunstone's non existant Customer Services and Technical Assistance!!

Sometimes once the account has been sent off to a collection agency, the company (One-tel in your case) doesn't even have an ability to do anything on your account. If you paid to One-tel after it's been sent off, maybe the collection agency doesn't have that information. You should talk to One-tel and get your account cleared up and have them pull your case from the collection agency. I don't think you will go anywhere if you were to sue them. Don't waste your time or money.

Yes, if they are trying to collect on a debt that has been paid, that is against The Fair Collections Act, and you can sue them for punative damages if a negative mark ends up in your credit report as a result of something that occurred after you paid the bill. I hope you have proof that you actually paid the bill. You probably will need to get an attorney by the way.

You can sue someone for just about anything. The question is will you win. I'm not a lawyer but I would think you would have to prove that the company knew the payment was made and knowingly didn't update your credit file. Also, if it was late to begin with through your own fault a judge may rule it's your fault to begin with.

Find out if you can sue them for a "Declaratory Jugdment" where the court would state that you do not owe the money. And if the continue to pursue them then you can bring a civila action against them or they could be held in contempt of court. Dont let them bully you!

You have the legal right to notify them in writing to stop communicating with you, and they must stop immediately.

slander is spoken, written is libel. but you need to consult a solicitor and show them proof of correspondence and of payment. no one else can really help you!
