Are you so sure it wasn't Illegal?
Sometimes there is law against whatever they where charged for, but was very vague...
Correction... They can change the punishment of the crime to be more severe and even get rid of a law, but I do not think that they can enact a law and retroactivly enforce it when it was not illegal in the first place.

Ex Post Facto Law is the right term for a law that is passed by Congress to make an act illegal after it was committed.
