My friend was riding in another vehicle that was stopped and searched. The driver had about 4oz cocaine and was charged with possession with intent to sell/distribute. Since my friend was a passenger, she was charged with the same also. It's a first offense for her. What are her chances of staying out of jail? She had no knowledge of the drugs in the vehicle.

she was charged with criminal possession of a narcotic with intent to sell, criminal possession of a hallucinogen with intent to sell, criminal possession of a hallucinogen and criminal possession of cocaine, all felonies. She was grabbing a ride home from a night out with friends. The driver claims the passenger had no idea of the drugs in the vehicle. Any idea of what's to be expected?

Has she been charged by the district attorney yet? If there is no evidence against your friend, then probably nothing will happen. However, sounds like you are not getting the whole truth. Cocaine is a narcotic not a hallucinogenic-so what other drugs were in that car?

4oz is a lot of cocaine to not know about. It depends on a LOT of factors including: criminal record of the driver, why she got in the car/the passenger's relationship with the driver, the exact location of the discovered cocaine, etc....Personally, i don't think she'll get out of it without jail time of some kind, or at the very least community service and a large fine. Big lesson: don't ride in a ******* coke dealer's car!

If they found the drugs on the driver like in his pockets and/or in his jacket then your friend cannot be charged with any crime, but if the drugs were found under the car seat or in the car itself then your friend could be charged. Of course if he/she don't do drugs then he/she can submit hair follicle testing to prove innocents of abuse relieving any charges pending. My advice, get a lawyer.

ur friend probaly wasnt riding with a very cool person cause the only way shed be getting charged also is if the driver also said it wasn't there's therefore the blame goes on the both of them. The driver should fess up to let her off the hook.

Probably not. Most of the outcomes of trials and plea agreements do not differ with having a public defender and having a private attorney.

If the drugs were on the person not stashed in the car. Then this shud be as simple as hiring a good lawyer. Lots of people are charged with things that are incorrect in the hopes people will fall into compliance of cops. (not the law, police state behaviour) Unfortunaly the gov. knows most people can't hire decent lawyers and do things like this to scare the public into submission of their whims,

I guess the driver needs to tell the cops she didn't know he had cocaine in the car

If she were able to afford a good enough lawyer she could probably stay out of jail. If she's stuck with a public defender or represents herself she's screwed.

her chances... im not sure, it depends on how they charge people with those kind of things in ur area! She would most likely go to jail, but probably not for long!

Unfortunately, it is called guilt by association.

I try to make sure my children understand they even though they did not do the crime, IF they are around people who are doing it, they can be dragged into the punishment.

Happens all the time! Careful of the friends you chose!
