This is a serious question so please only answer if you know the answer; There's this girl who is 18 now but she was 17 when this happened she claims a 20 year old guy raped her and I know him and he would never do that, and everybody knows that she has slept around with alot of guys before anyways, well obviously she told her parents he raped her and now he is going to jail for five years, but she told her friend which told me that he did not do it, she was just getting back at him, is there anyway to prove him not guilty or is he automatically guilty because the girls parents are pressing charges of him having sex with a minor? Please if anyone knows tell me, This girl has to be stoppped, it just isnt fair!!!

Talk to the police about this but remember this. The Police don't care if he's innocent or not because they just want a conviction. If the truth is well known by all...... the police will have to act in his favor. Now...That said please remember this. If she is underage and "even" if she wanted to have sex he will be charged with rape. An underage girl can not agree to have sex. In my state ( Michigan ) the age is 16 for consent. In California ( For example ) it is 18. So a man can't be put in prison for having sex with a 17 year old in Michigan but in California a man will go to prison. Parents are funny people.....And it is understandable......If some older guy bangs a father's underage daughter the father ( And Mother ) will press charges. It's human nature. However!!! If she "NEVER" had sex with him you should contact the proper people in power. Good luck to all.

Regardless if he did or not Hun her parents can press charges against him b/c 1 there is no statue of limitations on rape. 2 because she was a minor the parents can file statutory rape charges against him b/c she was a minor although I now it's not really fair that's the way the courts work. Not all cases are true but they also think on this hand it can be true. No one will actually now the truth but her and the guy in question. I'm not saying he is guilty but no one can ever truly now someone completely. As for her friend telling you different that goes with the he said she said drama. Believe what you feel and that's all you really can do. How many people she has been with is immiscible in a court of law. Those were choices she made she claims this one was not.

To answer the question of Rape, and how to define it. I had to take a class at a college that I went to, it was more for the men but I was curious so I took the class.
The instructor said that even if the sex starts out as being consensual. And it continues to progress, once the female says "Stop", Or "No" and the guy continues legally it is considered Rape. Because once someone does not want to continue the guy maybe thinking No means Yes.
If the female says "No" or "Stop" again. There should not be a doubt about her position on the sex.
If the man continues it is considered RAPE by law. I am also have a degree in Criminal Justice. Rape is Rape if the other person says NO or Stop and the guy continues.

I am no expert on this topic however I have taken some law courses and in high school a similar thing was happening so in our family life class we discussed it. I would highly suggest talking with your friends lawer (as he should have a lawyer even if it is one assigned to him by the court/state/province/etc)
There are several things which come into play here. First of all the age of consent for where you live and did he actually have some sort of sexual intercourse with her.
Because if the age of consent where you live is 18 or above and he did have sex with her then there is almost nothing you can do as her parents have a very strong case even if she did consent.
However if the age of consent is under 18 or he did not have sex with her (and you can prove this) then you might be able to help.
Also, and I am not sure how the laws work in your area so I will explain how it is in PEI, Canada. The age of consent is 14 (yes I know that is really young) but it is still considered statutory rape if there is a larger age gap then 2-3 years and one of the people is under the age of 18.

Falsely accusing somebody of rape is a crime in itself. I recommend her friend make a report to the police about what the accuser said to her. If this doesn't work, or even if it does, talk to the man's defense attorney.
I know somebody who was falsely accused of child abuse, out of spite. The children did not confirm the accusation, and the officer told the accuser that she could be put in jail for what she did. So she withdrew her accusation.
It may be that, if you can quickly show the police or attorneys that the accuser is lying, she may change her story.
I hope she can be punished as well; people like her make it harder for the real rape victims.

Well being charged for "rape" and "sex with a minor" are 2 different things as far as i know!!
I had a friend in school and she did it to her best friends dad! Accused him of raping her and went to court got avo's and then the lawyers eventually got the truth out of her as she stumbled with her story!!
Believe me if this girl is lying she will make herself come undone!!
What goes around comes around, if she were to actually be raped would anyone actually believe her then!!

Maggie, life isn't fair. Even if the charges of rape are false, we live in a society that when that type of allegation is made, men are considered guilty until proven innocent. This is especially true if they had consensual sex and she claimed rape after the fact because the DNA evidence of his seamen in her vagina will be damning evidence against him.
The morale of this dilemna is be careful of who you choose to have relations with.

What evidence do they have? If she has no evidence then it won't go through. Get the friend to testify. Make sure you don't choose a jury trial since often a jury will side with the girl. It her word against his so try to prove her wrong. make her trip up her story so she does not seem reliable.

If that girl is minor and sleeping with many, then you will get a number of proofs and alibi. Go to the court.
